Privacy Policy
If you do not agree to these Terms, you must not use this app. This document explains platform responsibilities, account requirements, service liability, data use, and how to contact Jodarsh.
1. About the Platform
Jodarsh is an open marketplace operating exclusively within India that connects individuals and businesses (Clients) with independent skilled daily-wage workers (Workers) offering physical labour services including, but not limited to, plumbing, electrical work, painting, cleaning, carpentry, and similar trades.
The platform is available to:
- Individual homeowners seeking on-demand labour
- Businesses and offices requiring maintenance or facility services
- Contractors seeking to engage sub-workers for a project
2. Acceptance of Terms
By creating an account, accessing, or using Jodarsh, you confirm that:
- You have read, understood, and agree to these Terms
- You are at least 18 years of age
- You are legally capable of entering into a binding contract under the Indian Contract Act, 1872
- If registering on behalf of a business, you are authorised to bind that entity to these Terms
3. User Accounts
3.1 Registration
All users must register an account by providing accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
3.2 Account Types
- Client Account: For hiring Workers through the platform
- Worker Account: For listing services and accepting job offers
- A single individual can hold both account types simultaneously with proper identification approval from Jodarsh.
3.3 Account Security
You must notify us immediately at jodarsh.com@gmail.com if you suspect any unauthorised use of your account. Jodarsh will not be liable for any loss resulting from unauthorised account access due to your failure to safeguard credentials.
4. Worker Verification
Jodarsh conducts a background verification and identity check on all Workers before they are permitted to list services on the platform. This process may include:
- Government-issued photo ID verification (Aadhaar, Voter ID, PAN, Passport, or Driving Licence)
- Address verification
- Criminal background screening via authorised third-party agencies
5. Nature of the Relationship
Jodarsh acts solely as a technology intermediary that facilitates connections between Clients and Workers. The following points clarify the nature of all relationships on this platform:
- Jodarsh is not an employer, staffing agency, or contractor.
- Workers are independent contractors, not employees or agents of Jodarsh.
- No employment, partnership, joint venture, or agency relationship is created between Jodarsh and any Worker or Client by virtue of these Terms or use of the platform.
- Any agreement for services is a direct contract between the Client and the Worker. Jodarsh is not a party to that agreement.
6. Responsibilities and Liability for Services
6.1 Worker Responsibilities
Workers agree that they are solely and fully responsible for:
- The quality, standard, and completion of any service they agree to provide
- Any damage to property, equipment, or premises caused during or as a result of their work
- Any personal injury caused to themselves, the Client, or third parties during service delivery
- Compliance with all applicable laws, safety regulations, and professional standards while performing services
- Maintaining their own tools, equipment, and any required licences or certifications
6.2 Client Responsibilities
Clients agree that they are responsible for:
- Providing a safe working environment for the Worker
- Accurately describing the scope and nature of the job when posting a listing
- Ensuring timely payment to Workers as agreed
- Treating Workers with respect and dignity in accordance with applicable labour laws
6.3 Platform Liability
Jodarsh is not liable for and expressly disclaims all responsibility for:
- The quality or outcome of any service performed by a Worker
- Any property damage, personal injury, or financial loss arising from a service engagement
- Disputes between Clients and Workers
- Failure of a Worker to show up or complete a job
- Misrepresentation by either party during registration or service listing
7. Payments
7.1 Current Payment Method
At present, all payments for services are made directly between Clients and Workers. Jodarsh does not process, hold, or facilitate financial transactions between the two parties at this time.
7.2 Future In-App Payments
We intend to introduce an integrated in-app payment system in the future. When this feature is launched, additional payment terms, processing fees, refund policies, and transaction conditions will be communicated to users and will form part of these Terms.
7.3 Payment Disputes
Any disputes regarding payment amounts, non-payment, or partial payment are a matter solely between the Client and the Worker. Jodarsh may, at its sole discretion, offer a mediation service but is under no obligation to resolve financial disputes between users.
8. Off-Platform Arrangements
Jodarsh is built to be the ongoing platform of engagement between Clients and Workers. While we understand that once a connection is made some communication may occur off-platform, we strongly discourage arranging or conducting services entirely outside the platform for the following reasons:
- You lose access to our dispute resolution process
- Worker verification and review protections no longer apply
- Jodarsh bears no liability whatsoever for arrangements made off-platform
Repeated or systematic attempts to circumvent the platform (for example, directing newly found workers or clients away from the app entirely) may result in account suspension or termination.
9. Prohibited Conduct
All users are strictly prohibited from:
- Providing false or misleading information during registration or in listings
- Harassing, threatening, or abusing any other user of the platform
- Discriminating against a Worker or Client on the basis of caste, religion, gender, disability, or any other protected characteristic
- Posting listings for illegal services or activities
- Using the platform to solicit or engage in any unlawful activity
- Attempting to hack, scrape, or compromise the platform's security or integrity
- Creating multiple accounts to abuse ratings, reviews, or promotional offers
- Posting fake or misleading reviews
10. Reviews and Ratings
After the completion of a service, Clients may leave a review and rating. You agree that all reviews must be:
- Honest, accurate, and based on your genuine first-hand experience
- Free from abusive, defamatory, or hateful language
Jodarsh reserves the right to remove any review that violates these standards. We do not edit reviews on behalf of any party.
11. Intellectual Property
All content on Jodarsh, including the name, logo, interface design, code, text, graphics, and trademarks, is the exclusive property of Jodarsh and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable Indian intellectual property laws.
You may not copy, reproduce, distribute, reverse-engineer, or create derivative works from any part of the platform without prior written consent from Jodarsh.
12. Privacy and Data
Your use of Jodarsh is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the platform, you consent to the collection, storage, and processing of your personal data as described in the Privacy Policy, in accordance with the Digital Personal Data Protection Act, 2023 (DPDPA) and applicable Indian law.
12.1 Location Access
Jodarsh requires access to your device's location to function properly. Location data is used to:
- Show you nearby Workers or available jobs in your area
- Help Workers navigate to the Client's premises accurately
- Improve matching accuracy between Clients and Workers based on proximity
Location access is used solely for the purpose of delivering the core features of the app. You may disable location access through your device settings at any time, though this may limit the functionality of the platform.
Jodarsh is committed to protecting your personal information. We do not sell, rent, trade, or share your personal data, including your location, contact details, and usage information, with any third party for commercial, marketing, or any other purposes.
13. Termination of Account
Jodarsh reserves the right to suspend or permanently terminate any account, at its sole discretion and without prior notice, if a user:
- Violates any provision of these Terms
- Engages in fraudulent, abusive, or illegal activity on the platform
- Receives repeated negative reviews indicating unsafe or unprofessional conduct
- Provides false information during verification
Upon termination, your right to access the platform ceases immediately. Jodarsh may retain data as required by law.
14. Disclaimers
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. JODARSH DOES NOT WARRANT THAT:
- The platform will be uninterrupted
- Search results will yield suitable or available Workers at any given time
- Any Worker listed on the platform is fit for a specific purpose
To the maximum extent permitted under the Information Technology Act, 2000 and other applicable Indian law, Jodarsh limits its total liability to you to INR 1,000 (Rupees One Thousand Only) for any claim arising from use of the platform.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms or the use of the platform shall first be attempted to be resolved through good-faith negotiation between the parties.
If negotiation fails, the dispute shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be [City, State], India, and proceedings shall be conducted in English.
For consumer disputes, nothing in this clause limits a user's right to approach the appropriate Consumer Forum under the Consumer Protection Act, 2019.
16. Changes to These Terms
Jodarsh may update or modify these Terms at any time. Where changes are material, we will notify you via in-app notification or email at least 7 days before the changes take effect. Your continued use of the platform after the effective date of the revised Terms constitutes your acceptance of those changes.
